Please review the following terms before using WebWMS2U Cloud.

1. Acceptance of Terms

By accessing, registering for, or using WebWMS2U Cloud, you agree to be bound by these Terms & Conditions. If you do not agree with these terms, you should discontinue use of our services immediately.

2. Service Description

WebWMS2U Cloud is a cloud-based messaging middleware platform operated by XGEN Technologies Sdn Bhd. It provides WhatsApp messaging tools, automation features, APIs, keyword-based replies, webhook integrations, contact management, reporting, and related business communication services.

The service may support different messaging channels, including but not limited to WhatsApp via Meta Cloud API, WhatsApp via connected personal devices, SMS gateways where applicable, and other supported messaging integrations.

3. Account Registration and User Responsibilities
  • You must provide accurate, complete, and up-to-date account information.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activities performed under your account.
  • You must not share, resell, sublicense, or transfer your account without our written permission.
  • You must use the platform only for lawful business communication purposes.
4. Message Content and Sender Responsibility

You are solely responsible for all messages, campaigns, contact lists, templates, files, links, and content sent or processed through your WebWMS2U Cloud account.

You must ensure that your messages comply with all applicable laws, regulations, industry rules, telecommunications requirements, and third-party platform policies.

5. Consent and Contact Lists
  • You must only send messages to recipients who have provided valid consent or where you have a lawful basis to contact them.
  • You are responsible for maintaining proof of consent where required.
  • You must respect unsubscribe, opt-out, stop, or removal requests from recipients.
  • You must not upload or use purchased, scraped, stolen, harvested, or unauthorized contact lists.
  • You must not impersonate another person, company, brand, or sender identity.
6. Acceptable Use Policy

You agree not to use WebWMS2U Cloud for any activity that is unlawful, abusive, harmful, deceptive, or damaging to WebWMS2U Cloud, our infrastructure, our upstream providers, other users, recipients, or third-party platforms.

You must not use WebWMS2U Cloud to send, promote, facilitate, or distribute:

  • Spam, unsolicited bulk messages, or unauthorized marketing messages.
  • Phishing, scams, fraud, impersonation, or deceptive content.
  • Malware, viruses, suspicious links, or harmful software.
  • Illegal products, illegal services, or unlawful activities.
  • Harassing, threatening, abusive, hateful, or discriminatory content.
  • Misleading financial, investment, loan, prize, or giveaway messages.
  • Content that infringes intellectual property, privacy, or other rights.
  • Messages that violate WhatsApp, Meta, SMS gateway, carrier, or telecommunications provider policies.

You also agree not to:

  • Attempt to bypass rate limits, security checks, authentication, billing, or usage restrictions.
  • Access, test, scan, or attack our systems without written permission.
  • Use automated scripts, bots, or abusive traffic patterns that may affect service stability.
  • Reverse engineer, copy, modify, or exploit any part of the platform.
  • Use the service in a way that may cause numbers, sender IDs, WhatsApp accounts, or gateways to be blocked, banned, restricted, or blacklisted.
7. WhatsApp-Specific Terms

If you use WhatsApp-related features, you are responsible for complying with all applicable WhatsApp and Meta rules, including business messaging policies, commerce policies, template requirements, opt-in requirements, and messaging limits.

WebWMS2U Cloud does not control decisions made by WhatsApp, Meta, device providers, mobile networks, or third-party gateways. We are not responsible if your WhatsApp number, business account, template, sender identity, device session, or messaging capability is restricted, suspended, banned, limited, or reviewed by any third party.

8. SMS-Specific Terms Where Applicable

If SMS services are enabled for your account, you are responsible for ensuring that your messages comply with applicable telecommunications, anti-spam, privacy, marketing, and consumer protection requirements.

SMS delivery may depend on mobile networks, sender ID approvals, gateway availability, recipient device status, routing conditions, filtering, and carrier-level restrictions. Delivery times and delivery success are not guaranteed.

9. API and Webhook Usage
  • You must keep your API keys, webhook URLs, tokens, and credentials secure.
  • You must not expose API keys publicly or share them with unauthorized parties.
  • You must not use the API in a way that causes excessive load, instability, abuse, or service disruption.
  • We may apply rate limits, throttling, verification checks, or temporary restrictions where necessary.
  • You are responsible for securing your own systems that connect to WebWMS2U Cloud APIs and webhooks.
10. Credits, Subscription Plans, Payments and Refunds

WebWMS2U Cloud may operate using prepaid credits, subscription plans, usage-based billing, or other commercial arrangements. You are responsible for monitoring your credit balance, subscription status, usage, and renewal dates.

  • Credits are generally non-refundable unless otherwise stated in writing.
  • Unused credits may expire according to the applicable plan, promotion, or account terms.
  • Payments are final once processed, except where a refund is approved by us due to verified service issues.
  • We may suspend or restrict services for accounts with expired plans, insufficient credits, unpaid invoices, chargebacks, or suspected payment abuse.

11. Service Availability

We aim to provide a reliable service, but WebWMS2U Cloud is provided on an “as available” basis. Service may be interrupted due to maintenance, upgrades, network issues, third-party provider issues, security incidents, gateway failures, device disconnections, Meta or WhatsApp limitations, carrier restrictions, or circumstances beyond our control.

12. Account Suspension and Termination

We reserve the right to suspend, restrict, or terminate your account without prior notice if we believe that:

  • You have violated these Terms & Conditions.
  • Your account is being used for spam, fraud, phishing, abuse, or unlawful activity.
  • Your usage may harm WebWMS2U Cloud, our infrastructure, our upstream providers, other users, or recipients.
  • Your activity may expose us to legal, regulatory, commercial, security, or reputational risk.
  • Your account has unpaid invoices, expired subscriptions, insufficient credits, or disputed payments.
13. Data Privacy

We respect your privacy. Please refer to our Privacy Policy for information about how we collect, use, store, process, protect, and retain personal data.

14. Third-Party Services

WebWMS2U Cloud may connect to third-party services, including but not limited to Meta, WhatsApp, SMS gateways, mobile networks, hosting providers, analytics providers, payment providers, and integration platforms.

We are not responsible for the availability, performance, policy decisions, pricing changes, account restrictions, delivery failures, or actions of third-party providers.

15. Intellectual Property

All software, platform design, documentation, branding, logos, source code, workflows, interfaces, and related materials provided by WebWMS2U Cloud remain the property of XGEN Technologies Sdn Bhd or its respective licensors.

You may not copy, reproduce, distribute, modify, resell, or create derivative works from any part of the platform without written permission.

16. Limitation of Liability

WebWMS2U Cloud is provided “as is” and “as available”. To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or business losses arising from your use of, or inability to use, the service.

This includes but is not limited to loss of profits, loss of data, loss of business, message delivery failure, account suspension by third parties, number blocking, downtime, service interruption, or reputational damage.

17. Indemnity

You agree to indemnify and hold harmless XGEN Technologies Sdn Bhd, its directors, employees, partners, suppliers, and service providers from any claims, losses, damages, penalties, costs, or expenses arising from your use of WebWMS2U Cloud, your message content, your contact lists, your breach of these Terms, or your violation of any law, regulation, or third-party policy.

18. Changes to These Terms

We may update these Terms & Conditions from time to time. Any changes will be posted on this page. Continued use of WebWMS2U Cloud after changes are posted means you accept the updated terms.

19. Governing Law

These Terms & Conditions shall be governed by the laws of Malaysia, unless otherwise required by applicable law.
